By using AUGUST STORE PRE-LOVED CLOSET, YOU represent and warrant that you are more than 18 years of age or are visiting AUGUST STORE PRE-LOVED CLOSET with the permission and supervision of a parent or guardian. Subject to these terms and conditions, AUGUST STORE PRE-LOVED CLOSET hereby grants you a limited, revocable, non-exclusive license to access and use the AUGUST STORE PRE-LOVED CLOSET website on your computer or mobile device. The Service provides an online marketplace where Users can sell or buy pre-loved fashion items (pre-loved items, used items, second-hand items). Users who purchase Items are called “Buyers”, and Users who sell Items are called “Sellers”. These pre-loved items are categorised by AUGUST STORE PRE-LOVED CLOSET as luxury fashion goods. 

1.1 USER REVIEWS, PHOTOS & COMMENTS

Anything posted or otherwise submitted to AUGUST STORE PRE-LOVED CLOSET whether on the AUGUSTSTOREOFFICIAL-PLC.com website, blog or via any form of social media (including by submitting an image to your social media using #AUGUSTSTOREOFFICIAL, #AUGUSTSTORE, or other AUGUST STORE branded hashtag), will be treated as public and nonproprietary. By submitting photographs, comments or other materials to AUGUST STORE PRE-LOVED CLOSET, you grant AUGUST STORE PRE-LOVED CLOSET a royalty-free, worldwide, perpetual, irrevocable and transferable right to use, copy, distribute, publish and modify such submissions and the right to use your username, real name, image, likeness, and other personal attributes in connection with any use of such submissions. All such submissions shall automatically become AUGUST STORE’s sole and exclusive property. In addition, when you post photographs, reviews or comments to AUGUST STORE or on any of AUGUST STORE’s social media networks, you also grant us the right to use the name that you submit, if any, in connection with that submission. Anything you submit must not violate any right of any third party, and must not contain any libellous, abusive, obscene or otherwise unlawful material. You represent and warrant that you own or have obtained appropriate rights and permissions from any and all other persons and/or entities who own, manage or otherwise claim any rights with respect to any content submitted to AUGUST STORE.

1.2 INTELLECTUAL PROPERTY RIGHTS

All graphics, images and content on the AUGUSTSTOREOFFICIAL-PLC.com website, and blog belong exclusively to AUGUST STORE, or its affiliates. The use of any AUGUST STORE PRE-LOVED CLOSET trademarks or service marks without AUGUST STORE’s express written consent is strictly prohibited. You may not use AUGUST STORE PRE-LOVED CLOSET’s trademarks or service marks in connection with any product or service that is in any way likely to cause confusion or to disparage or discredit AUGUST STORE. In addition, you may not use any of AUGUST STORE PRE-LOVED CLOSET’s trademarks or service marks in meta tags without AUGUST STORE PRE-LOVED CLOSET’s explicit prior consent.

1.3 PRODUCT DETAILS 

Product images are for illustrative purposes only and may vary from the actual product. Due to differences in monitors, colours of products may also appear different to this shown online.

2. AUTHENTICATION OF PRODUCTS 

Our product authentication process is independently conducted in-house by Our team. Brands identified on or through the Service: (i) are not involved in the authentication of the products being sold through the Service, and (ii) do not assume responsibility for any products purchased from or through the Service. Brands sold on or through the Service are not partners or affiliates of Us in any manner. However, We fully cooperate with brands seeking to track down the source of counterfeit items, which may include, when required by court order or directive of law enforcement,  revealing the contact information of consignors submitting counterfeit goods. We may also, when required by court order or directive of law enforcement, reveal to brands the contact information of consignors submitting products that have been challenged as infringing, unapproved, suspicious, potentially stolen, or offered for sale in an unauthorised geographic market.

3. SELLER 

ONLY USERS OF THE MALAYSIAN REGION ARE ELIGIBLE FOR REQUEST TO SELL PRE-LOVED ITEMS TO AUGUST STORE PRE-LOVED CLOSET. Pre-loved items will be sold outright to AUGUST STORE PRE-LOVED CLOSET on the agreed price offered by AUGUST STORE. 

SELLER agrees that the items sold are in good condition as stated in the Pre-Loved Item Submission Form. In any circumstances during the assessment of the item(s) that the item(s) has been found to have defects which is undeclared and/or counterfeit, AUGUST STORE PRE-LOVED CLOSET has the right to reject the item and revoke the acceptance of the product.

4. BUYER

BUYER is responsible for reading the product description upon making the final purchase decision. AUGUST STORE PRE-LOVED CLOSET is not liable for any change of mind.

5. TERMS OF PAYMENT  

5.1 SELLER PAYMENT 

SELLER will receive payment in the form of AUGUST STORE CREDIT NOTE via gift voucher. An email will be sent upon issuance of the gift voucher by AUGUST STORE. The said gift voucher is only to be used on the main AUGUST STORE website (https://auguststoreofficial.com). Ownership of the pre-loved item(s) solely belongs to AUGUST STORE PRE-LOVED CLOSET upon issuance of the gift voucher.  

Gift vouchers issued are in the form of RM50(s), RM100(s), RM150(s), RM200(s), RM250(s), RM300(s), OR RM500(s). 1 or more gift vouchers will be issued for each application approved and accepted (after assessment by AUGUST STORE) individually. 5.2 BUYER PAYMENT

The BUYER must pay the Price, Carriage Costs and any other applicable costs via the secure payment gateway of AUGUST STORE PRE-LOVED CLOSER, by bank card via the PayPal system. In order to be able to pay using PayPal, the Buyer must have a PayPal account; the Buyer shall then be subject to the Terms of Use of PayPal, which can be viewed on the web site of PayPal, by selecting the appropriate country on the page that is displayed by clicking here. PLEASE NOTE THAT PAYPAL’S TERMS OF USE MAY VARY FROM COUNTRY TO COUNTRY.

6. SHIPPING

AUGUST STORE PRE-LOVED CLOSET ships orders using Malaysia Post, Pos Laju & DHL Express. Please note we use various services, depending on the cost & speed of delivery required. Domestic orders are shipped using Pos Laju & may require a signature on delivery. Please consider the security circumstances of your delivery address, as we cannot be held responsible for stolen parcels. Full tracking is available using this service. International orders sent using DHL Express & offer full tracking & do require a signature on delivery. Please consider the security circumstances of your delivery address, as we cannot be held responsible for stolen parcels. Full tracking is available using this service. 

We will not be held responsible for parcels that are redirected to a local post office for collection. Please ensure your delivery address is accurate, as we cannot be held responsible for a delayed parcel due to incorrect entry of details. Make sure to provide us with your contact number upon purchasing.Orders placed on a weekend day, will be processed within 48 hours. AUGUST STORE PRE-LOVED CLOSET is unable to dispatch parcels over the weekend. 

Please note, during sale periods & times of seasonal offers, dispatch of orders & in turn delivery times may be delayed. We aim to process all orders in a timely manner, but we ask for your patience in order processing.

6.1 SHIPPING FOR SELLER

Pre-loved items approved by AUGUST STORE PRE-LOVED CLOSET shall be shipped to the given address at the cost of the SELLER. 

6.2 SHIPPING FOR BUYER 

FREE SHIPPING FOR MALAYSIAN ORDERS AND INTERNATIONAL ORDERS ABOVE MYR1000. A chargeable shipping fee of MYR90 will be applicable to international orders below MYR1000. Any delivery date or time specified by us is a best estimate only & AUGUST STORE PRE-LOVED CLOSET will not be held liable for any loss or damage suffered through any reasonable or unavoidable delay in delivery. Orders are subject to availability. Orders will be delivered between Monday - Friday 10 am - 5 pm, please note deliveries are not made on weekends.

7. TAXES

Purchased items may be subject to applicable customs taxes in your jurisdiction. Please refer to YOUR region location of the chargeable customs taxes & duties. AUGUST STORE PRE-LOVED CLOSET IS NOT LIABLE TO ANY CUSTOMS TAXES & DUTIES CHARGEABLE TO YOU BY YOUR COUNTRY OF RESIDENCE.

8. RETURNS

By agreeing to the terms, BUYER agrees to leave authentication and assessment decisions in accepting the pre-loved item to be sold on the marketplace to August Store. BUYER is responsible for making the final decision in purchasing the item and WILL NOT BE ELIGIBLE TO ANY  EXCHANGE OR RETURNS for transactions made under August Store Pre-loved Closet.

9. INTERNATIONAL ACCESS

Customers who access and use the AUGUSTSTOREOFFICIAL.com website from outside of Malaysia are responsible for complying with THEIR local laws and regulations. Occasionally a vendor requests that AUGUST STORE restrict the sale of their brand to certain countries. Though AUGUST STORE prefers not to limit the brands AUGUST STORE sells, AUGUST STORE must honor its vendor’s wishes. However, AUGUST STORE continually reviews such restrictions with its vendors to see if any changes can be made.

10. DISCLAIMER; LIMITATION OF LIABILITY; RISK OF LOSS

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, TITLE, QUIET ENJOYMENT, DATA ACCURACY AND SYSTEM INTEGRATION. THIS SITE MAY INCLUDE INACCURACIES, MISTAKES OR TYPOGRAPHICAL ERRORS. WE DO NOT WARRANT THAT THE CONTENT WILL BE ERROR FREE OR UNINTERRUPTED. 11. ERRORS

Accidents happen. In the event that a product is listed incorrectly (e.g. price or description) due to a typographical error or other mistake, we reserve the right to refuse or cancel any orders that may have been placed for such a product listed. If your credit card has already been charged for such an erroneous purchase, we shall issue a credit to your card for the full amount of the charge.
